Privacy Policy
This Privacy Policy explains what information Finality collects, how we use it, who we share it with, and the choices you have. Finality is operated by Tempered Technologies LLC, a Delaware limited liability company. By using the Service, you agree to this Policy.
Short version: we collect the minimum we need to run an account and a subscription — your name, your email, and your payment method (handled by Stripe, not stored by us) — plus basic usage information to operate the Service. We don’t sell your personal information. Our marketing site sets no cookies and loads no third-party trackers.
1. Information we collect
Information you provide
- Account information — your name, business name, and email address when you sign up for a trial or a subscription.
- Payment information — when you subscribe, your card or payment details are collected and processed by our payment processor, Stripe. We do not receive or store full card numbers. We receive limited billing metadata from Stripe (such as the last four digits, card brand, expiration, billing country, and subscription status) to manage your account.
- Communications — the contents of emails, calls, or messages you send us.
Information collected automatically
- Usage and log data — when you use the authenticated Service, we record activity such as sign-ins, pages and cases viewed, case activations, and timestamps, along with technical data like IP address and browser type. Customer access is authenticated, tier-gated, and audit-logged; this log is used to operate, secure, and support the Service.
- Cookies — the public marketing site (finalityreport.com) sets no cookies and loads no third-party trackers. The authenticated application uses a strictly necessary session cookie to keep you signed in. Stripe’s checkout may set its own cookies under Stripe’s privacy policy.
Case data within the Service
The case intelligence in the Service is compiled, derived, and enriched through Finality’s proprietary intelligence system. This data describes the subjects of surplus cases — not Finality customers — and is provided to a customer only for the purpose of evaluating and pursuing a surplus recovery. Customers agree to use it only for that purpose and in compliance with applicable law.
2. How we use information
- to create and manage your account and authenticate your access;
- to provide, operate, maintain, and improve the Service;
- to process subscription payments and per-case activation fees through Stripe;
- to communicate with you about your account, billing, support, and material changes to the Service;
- to secure the Service, prevent fraud and abuse, and maintain audit logs of access;
- to comply with legal obligations and enforce our Terms of Service.
3. How we share information
We do not sell your personal information. We share information only as follows:
- Stripe (payment processing). We share the information needed to process payments with Stripe, Inc., which processes it under its own privacy policy.
- Service providers. We may use vetted vendors for hosting, infrastructure, and analytics that process information on our behalf and under contract.
- Legal and safety. We may disclose information if required by law, subpoena, or legal process, or to protect the rights, property, or safety of Tempered Technologies LLC, our customers, or others.
- Business transfer. If we are involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.
4. Data retention
We keep account and billing information for as long as your account is active and as needed to provide the Service, then for a reasonable period afterward to meet legal, tax, accounting, and audit obligations and to resolve disputes. Audit and access logs are retained for security and compliance. You may request deletion of your account information as described below; some records may be retained where law requires.
5. Security
We use reasonable administrative, technical, and organizational measures to protect information, including authenticated and tier-gated access, audit logging, and reliance on Stripe for payment-card handling. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security.
6. Your rights & choices
- Access and correction. You can ask us to access or correct the account information we hold about you.
- Deletion. You can ask us to delete your account information, subject to legal retention requirements.
- Marketing. We do not run a marketing email sequence; any account or billing emails we send are transactional. If we ever send a non-transactional message, it will include an opt-out.
- Cancellation. You can cancel your subscription at any time — see the Refund & Cancellation Policy.
To exercise any of these, email contact@finalityreport.com or call +1 (202) 905-2771. We will respond within a reasonable time, consistent with applicable law.
7. Children
The Service is intended for businesses and is not directed to anyone under 18. We do not knowingly collect personal information from children.
8. Changes to this Policy
We may update this Policy from time to time. We will revise the “Last updated” date above and, for material changes, provide reasonable notice. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Policy.
