Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Finality service at finalityreport.com. Please read them carefully. By creating an account, starting a trial, subscribing, or otherwise using the Service, you agree to these Terms.

1. Who we are

Finality (the “Service”) is operated by Tempered Technologies LLC, a Delaware limited liability company (“Tempered,” “we,” “us,” or “our”). References to “you” or “Customer” mean the individual or business that accesses or subscribes to the Service. 2. What the Service is

Finality is a subscription information service. We compile and verify tax-deed surplus case intelligence and deliver it to subscribed operators as a live, continuously-monitored feed and, on activation, as decision-ready case files and structured data. Each case file identifies the party entitled to a surplus, the recoverable amounts, any competing claims, outstanding liens, and the applicable statutory deadlines, with each figure verified and traceable within our intelligence. The Service may also generate a pre-filled claim form for an activated case and provide ongoing monitoring of that case after activation.

What the Service is not. Finality is an information service only. We do not recover funds, represent claimants, contact former owners or lienholders, practice law, or provide legal advice, and we never take a share of any recovery. You are always the principal. Every figure we publish is a factual observation or a documented derivation and must be independently verified before you act on it. Nothing in a case file is a legal determination of any party’s entitlement.

3. Eligibility & accounts

  • You must be at least 18 years old and able to form a binding contract.
  • You are responsible for the accuracy of the information you provide and for keeping your account credentials confidential. You are responsible for all activity under your account.
  • Account access is per-customer, authenticated, tier-gated, and audit-logged. You may not share, resell, or sublicense your access, or permit access by anyone outside your business, without our written consent.
  • Notify us promptly at contact@finalityreport.com of any unauthorized use of your account.

4. Subscriptions, tiers & pricing

The Service is offered in the following tiers:

  • Trial — free. A no-cost view of the live feed: every GO-rated surplus case as a card, each with a net recovery band, a complexity grade, and region-level location. Individual cases may be activated on the Trial tier for the per-case activation fee described below.
  • Standard — $497 per month. A flat monthly subscription to the full GO-rated feed, adding entity tags, county-level location where case inventory supports it (region-level otherwise), and an “Escheatment Pending” status indicator. Individual cases may be activated for the per-case activation fee.
  • Exclusive — $1,497 per month, per county. A territory lock on a single county reserved to one operator, including all case activations at no per-case charge, exact net recovery figures on every case, full county-level detail, and priority case delivery.

The per-case activation fee is $97 and is included at no additional charge on the Exclusive tier. Prices are in U.S. dollars and exclude any applicable taxes. We may change pricing or tier features on a prospective basis; we will give notice of a price change before it applies to your next renewal, and a price change never alters a billing period you have already paid for.

5. Billing & renewal

  • Paid subscriptions are billed in advance on a recurring monthly cycle through our payment processor, Stripe. By subscribing, you authorize us, through Stripe, to charge your payment method the then-current fee for each billing period until you cancel.
  • Subscriptions renew automatically each month for a new one-month term, at the then-current price, unless cancelled before the renewal date.
  • We do not store full card numbers; payment details are handled by Stripe under its own terms and security standards. See our Privacy Policy for how payment data is processed.
  • If a charge fails, we may retry the charge and may suspend access until payment succeeds.

6. Cancellation & refunds

You may cancel a paid subscription at any time. Cancellation stops the next renewal; your access continues through the end of the billing period you have already paid for, and is not renewed thereafter.

Subscription fees are non-refundable, including for partial billing periods and unused time, except where a refund is required by law. Per-case activation fees are non-refundable once the case file has been released. Full details, and how to cancel, are in our Refund & Cancellation Policy, which is incorporated into these Terms.

7. Acceptable use

You agree not to, and not to permit anyone to:

  • use the Service or any data from it for any unlawful purpose, or in violation of any applicable law;
  • use any data from the Service for any purpose other than evaluating and pursuing a surplus recovery;
  • resell, redistribute, sublicense, scrape, or build a competing product from the Service or its data;
  • share account access outside your business, or exceed the scope of your tier;
  • misrepresent the Service’s output as legal advice or as a determination of legal entitlement;
  • interfere with, probe, or attempt to gain unauthorized access to the Service, its infrastructure, or other customers’ data.

Violation of this section is grounds for immediate suspension or termination without refund.

8. Intellectual property & license

The Service, including its software, case files, structured data, compilations, design, and underlying methodology, is owned by Tempered Technologies LLC and is protected by intellectual-property law. Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and the case files delivered to you for your own internal business use in pursuing surplus recoveries. You may use the case files we deliver in your own work, but you may not redistribute or resell the Service or its compiled data as a product.

9. No legal advice; no warranty of outcome

Finality provides factual observations and statutory references, not legal advice. Whether a claim is valid, barred, or worth pursuing is a legal and business judgment that is yours, or your attorney’s, to make. We do not guarantee that any case will result in a recovery, that any figure is exact, or that any deadline or party identity is current. Always independently verify before acting.

10. Disclaimers

THE SERVICE AND ALL CASE FILES AND DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that the underlying intelligence is complete or current.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEMPERED TECHNOLOGIES LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST RECOVERIES, OR LOST DATA, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Tempered Technologies LLC from any claims, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right — including any misuse of data obtained through the Service.

13. Suspension & termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if your payment fails, if we reasonably believe your use is unlawful or harmful, or if we discontinue the Service. On termination, your license to use the Service ends. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive termination.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide reasonable notice. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

15. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to venue there.
